OnlineLotto.co.za Terms and Conditions

1. This document sets out the terms and conditions (“Terms and Conditions”) of ENGAGE GLOBAL SOLUTIONS (2021/149347/07) 209 CLOCK TOWER BUILDING, DOCK ROAD VICTORIA AND ALFRED, WATERFRONT, CAPE TOWN pertaining to the access and use of the information and functions on https://www.onlinelotto.co.za or (“OnlineLotto.co.za”).
2. Should any person that accesses OnlineLotto.co.za (“you” or “user”) disagree with any of the Terms and Conditions, you must refrain from using OnlineLotto.co.za.
3. If you are under the age of 18 you may not make use of OnlineLotto.co.za.
4. NOTE: To the extent that the Terms and Conditions or any goods or services provided under the Terms and Conditions are governed by the Consumer Protection Act, 2008 (“Consumer Protection Act”), no provision of the Terms and Conditions is intended to contravene the applicable provisions of the Consumer Protection Act, and therefore all provisions of the Terms and Conditions must be treated as being qualified, to the extent necessary, to ensure that the applicable provisions of the Consumer Protection Act are complied with.
5. OnlineLotto.co.za reserves the right, in its sole discretion, to amend and/or replace any of, or the whole of, the Terms and Conditions. Such amendments shall supersede and replace any previous Terms and Conditions and shall be made available on OnlineLotto.co.za. Each time a user accesses OnlineLotto.co.za and/or uses the services, the user shall be deemed to have consented, by such access and/or use, to the Terms and Conditions, as amended and/or replaced by OnlineLotto.co.za from time to time. If you are not satisfied with the amended Terms and Conditions, you should refrain from using OnlineLotto.co.za. We will however give you prior notice where we have collected personal information from you and the purpose for which we collected that information, is affected by the intended amendment.
6. If there is anything in these Terms and Conditions that you do not understand then please contact us as soon as possible. Refer to clause 12.1 below for contact details. Please note that calls to us are charged at national rates and may be monitored for training, security and quality assurance purposes.
7. Making use of OnlineLotto.co.za will constitute your agreement to comply with these Terms and Conditions.

1. The Free Game Service and Free Competition Offer

1. OnlineLotto.co.za provides participants with access to Informative and Entertainment content Services, which consists of Free Game Service and a limited time Free Competition Offer as detailed in these Terms and Conditions (the “Offering”).
2. OnlineLotto.co.za can be described as five (5) fun, easy to play, daily lottery-style competition games which offer Participants the opportunity to win daily cash prizes in five (5) free games.
3. The Free Game Service and the Free Competition Offer is available from 1 January 2022 until such time as advised by OnlineLotto.co.za (the “Offer Period”). Notwithstanding the Offer Period, OnlineLotto.co.za may, amend the duration of the Offer Period to a shorter or longer period, or withdraw the Offering in its entirety, with notice to you.
4. To be eligible to participate, the participant (“Participant“) must (1) be a natural person and (2) be 18 (eighteen) years old or older.
5. Participation in this Offering excludes employees, directors, members, partners, consultants and agents of, or any other person who, directly or indirectly controls or is controlled by OnlineLotto.co.za or marketing service providers of this Offering, (and the spouses, life partners, immediate family members or business partners of the people or entities listed above. This includes the supplier/s of goods and or services in terms of this Offering and promotional partners, printers, advertising and promotional agencies, professional advisors and point of sale staff employed by or contracted to, or providing goods or services of any kind, to all the people or entities listed above during the Offer Period.
6. All OnlineLotto.co.za games are free as sponsored advertising is offered during gameplay.
7. How to qualify for the Free Competition Offer?

1. Participants must subscribe to the Free Game Service to qualify for the Free Competition Offer.
2. For each day that a Participant remains a subscriber to the Free Game Service the Participant shall receive 5 free entries in aggregate into five (5) lottery-style draws of increasing prize value and be notified by email if the Participant has won a Prize.
3. To Opt-out, the Participant will have to reply “Unsubscribe” to our service department at [email protected].
4. Participants will not be charged for replying, opting in and out of this Offering.

8. How to qualify for the Free Game Service?

1. To access this Offering, the Participant will have to login into the website and follow the instructions on https://www.OnlineLotto.co.za/my-account page for further subscription options.
2. The Participant will NOT be charged for entry into the daily competition.
3. The Free Game consists of the following services (1) advertiser banners, (2) lottery styled game and (3) and automated results content.
4. To Opt-out, the Participant will have to reply “Unsubscribe” to our service department at [email protected].
5. Participants will not be charged for replying, opting in and out of this Offering.

9. The Lottery Draw

1. The daily competition closes at 7pm CET and results are shown immediately after each draw on the https://www.OnlineLotto.co.za/results/ page. Entries for the next draw are freely available to participants on one (1) entry per participant, per day following each draw.
2. Winners will need to check their numbers against the automated outcomes and claim their entry winnings within FORTY-EIGHT HOURS (48h) of the draw or their claim is forfeit.
3. Participants acknowledge and accept that OnlineLotto.co.za may utilize a third party (the authorized agent/s) to contact the Participant, in the event that the Participant is a winner. In order to effect the contacting and payment process, OnlineLotto.co.za shall provide the Participant’s information to such a third party.
4. Historical draw entries are retained by OnlineLotto.co.za for Participants for up to one (1) month, thereafter may be deleted from the system.

10. Player Account Registration

1. Participants will be required to create an ID and password to open an account with OnlineLotto. Instructions for registration can be found on the “Register Now” section of the Website. Participants are asked to ensure that their player ID and password remain strictly private and confidential at all times. Participants must notify OnlineLotto.co.za immediately of any unauthorised use or suspected unauthorised use of their player ID or password, or of any breach of security known to them. Participants are responsible for all activities which occur under their player ID and password, save where such activities occur as a result of OnlineLotto.co.za’s negligence.
2. Participants must satisfy the following criteria for registration on the Site: (1) it is lawful for them to receive the Offering from OnlineLotto.co.za in the jurisdiction in which they are located; (2) Participants are at least 18 years of age; and (3) Participants provide a valid full name, contact telephone number and email address.
3. Participants residing or present in any jurisdiction where the Offering would be a prohibited activity are not permitted to register on this Website or engage in the Offering.
4. OnlineLotto.co.za reserves the right to require Participants to verify that they are eligible to register on the Website, to carry out checks or request information from Participants from time to time (during and after registration) and to refuse, suspend or cancel the registration of an account in its absolute discretion (for example, including but not limited to if a player provides any false, invalid or misleading information).
5. On completion of registration, Participants will be notified by email that their account is open and they will be able to play the games using the OnlineLotto.co.za Site, in accordance with these Terms and Conditions.
6. Participants can only have one (1) account. Maintaining more than one account will invalidate all entries.
7. Please note that Participants who deliberately attempt to mislead or make false winning claims will have their accounts closed immediately.
8. The player agrees that on registration they must provide a valid and correct full name, contact number and email address. Should either an incorrect name, nickname, invalid telephone number or email be provided, any winnings pertaining to that account will be automatically forfeited.

11. Account Cancellation

1. Participants can cancel their account at any time by sending an email to [email protected] stating that they wish to cancel their player account. If a player cancels their account, or if OnlineLotto.co.za suspends or cancels an account, any winnings held within a player’s online member account will remain in their account until verified payment instructions are received.

12. Free Play

1. Participants have the opportunity to win a prize, or the “Final Prize” (the “Final Prize”), in the following manner:
2. New Participants qualify for the next available daily draw as soon as they register.
3. Upon registration, Participants gain free entry to play Games 1 to 5 manually.
4. Participants manually select one (1) line in each of the five (5) competition games, which includes a maximum of one (1) free entry per day into their daily “Final Prize” draw.
5. Once the first five (5) games have been played, the player may only re-enter the for the next draw after the current draw takes place.
6. The player only gets a maximum of one (1) free entry per day into the daily “Final Prize” draw.
7. Participants may view all their entries on OnlineLotto.co.za anytime.
8. Entries are electronically stored in a player’s OnlineLotto.co.za account and are only valid for the draw stated on that entry.
9. Draws take place at [20:30 Central African Time] each day. Entries are considered closed or void one (1) hour before the daily draw.
10. Participants are obligated to check their entries against results on a daily basis.
11. Results are published on the “Results” page of OnlineLotto.co.za and Participants should check their entries after each draw to find out whether they have won a prize.
12. A player must make use of the corresponding winning reference number in order to claim a prize and must contact us within FORTY-EIGHT (48) hours of the relevant draw to start the pay-out process.
13. Prizes are claimed by sending an email to [email protected] confirming the name of the competition game, the date of the game played and your matching numbers.
14. Participants should note that the Final Prize may be presented in person for publicity purposes.

13. Winnings

1. Winners shall be contacted via the medium used to enter or in terms of any contact details supplied by the winner when entering. In the event that the winner is either uncontactable or in the event that the winner rejects, or declines acceptance of the Prize, the Prize shall be subject to a new draw.
2. The Prize is not transferable and is not exchangeable for another prize or cash and cannot be sold.
3. Winnings will be made to the Participants bank account in the player’s choice of South African Rand. Winnings will be paid at the rate of exchange given through OnlineLotto’s money transferring company and/or banking institution less any international bank fees charged.
4. Cash prizes, with the exception of the Final Prize, will be paid out within thirty (30) days of claiming your prize to the banking institution provided by the player less international bank fees, where applicable.
5. We do not issue said cash pay-outs through any other medium. OnlineLotto.co.za will only attempt to pay out said cash prizes one (1) time and will not be held responsible for any malfunction, error, cancellation, fee or any other problem with your given bank account, or any other reason whatsoever.
6. The Final Prize will be paid in 25 graduated payments over 25 years and in the same way as official USA lottery jackpots are usually remitted. Annuity payments will be made annually close to the anniversary date of the claim. Specifics of the Final Prize shall be solely determined by the Sponsor.
7. Anti-Money Laundering: In our genuine attempt to protect our player’s funds, we work according to Anti-Money Laundering laws and regulations when adhering to any form of player pay-out/ fund withdrawal and may require documents listed below to be submitted to our accounts department before the release of such pay-outs irrespective of amount or consistency. Our accounts department will then ensure that the documents provided are relevant and valid according to international standards. Documents required: Proof of Identity – A full coloured scanned copy of your passport, driver license or a government-issued ID card; Proof of Address – A valid utility bill such as water, electricity or gas bill. 8. Unclaimed Winnings: Any and all unclaimed Winnings will be retained by OnlineLotto.co.za for 6 months. If OnlineLotto.co.za, having endeavoured to contact the player by means of any email address and phone number specified in his/her player account, is unable to pay out the relevant Winnings to the relevant player within such 6 month period, then the relevant Participant shall cease to be entitled to claim such Winnings; and the Winnings shall either be forfeited to OnlineLotto.co.za or OnlineLotto.co.za shall be entitled to donate the unclaimed Winnings to a charity of its choice.

14. The decision of OnlineLotto.co.za in respect of disputes arising out of this Offering shall be dealt with by OnlineLotto.co.za in terms of these terms and conditions. The decision of OnlineLotto.co.za in this regard shall be final.
15. OnlineLotto.co.za reserves the right to withhold a Prize until it is entirely satisfied that the claimant of a Prize is the bona fide winner, and reserves the right to call for such proof as it may deem necessary.
16. OnlineLotto.co.za shall request that winners consent in writing to their name, image and likeness being used and published by OnlineLotto.co.za in connection with this Offering for a period of 12 (twelve) months after they are announced as winners. Winners may decline the use of their name, likeness and image by OnlineLotto.co.za.
17. Winners agree that it is an express condition of the Offering that in order to be eligible to redeem a Prize, a winner shall be required to sign the appropriate acknowledgement of receipt of the Prize, as well as an indemnity and/or waiver of liability as reflected in these terms.
18. By participating in this Offering all Participants give their consent to receive various marketing and promotional material from OnlineLotto.co.za. Participants will be provided with an opportunity to “Opt Out” of receiving such communications, which may be via the relevant medium that such marketing communication was received.

2. Content of OnlineLotto.co.za

1. OnlineLotto.co.za reserves the right to make improvements, to change or discontinue, without notice, any aspect or feature of OnlineLotto.co.za and any information or content on OnlineLotto.co.za.
2. OnlineLotto.co.za reserves the right to change the Offering from time to time without notice.
3. OnlineLotto.co.za may use the services of third parties to provide information on OnlineLotto.co.za. OnlineLotto.co.za has no control over this information and makes no representations or warranties of any nature as to its accuracy, appropriateness or correctness. The user agrees that such information is provided “as is” and that OnlineLotto.co.za and its online partners shall not be liable for any losses or damages that may arise from the user’s reliance on it, howsoever these may arise.
4. OnlineLotto.co.za makes no representations or warranties, whether express or implied, as to the accuracy, completeness or reliability of any information, data and/or content on OnlineLotto.co.za, including without limitation:

1. OnlineLotto.co.za does not warrant that OnlineLotto.co.za or information or downloads shall be error-free or that they shall meet any particular criteria of performance or quality. OnlineLotto.co.za expressly disclaims all implied warranties, including without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, compatibility, security and accuracy;
2. whilst OnlineLotto.co.za has taken reasonable measures to ensure the integrity of OnlineLotto.co.za and its contents, no warranty, whether express or implied, is given that any files, downloads or applications available via this Website are free of viruses, or any other data or code which has the ability to corrupt, damage or affect the operation of the user’s system; and
3. OnlineLotto.co.za disclaims any responsibility for the verification of any claims. Information published on OnlineLotto.co.za may be done so in the format in which OnlineLotto.co.za receives it and statements from external parties are accepted as fact.

3. Linked third party websites and third-party content

1. By participating in the Offering Participants are required to view third-party advertising banners. These third-party advertising banners are added extra concierge-style services offered by OnlineLotto.co.za and Participants are under no obligation to make use of or subscribe for these services.
2. Unless specifically authorised by OnlineLotto.co.za, you may not connect deep links to the Website, i.e., create links to this Website that bypass the home page or other parts of the Website. You may not mirror or frame the home page or any other pages of this Website on any other website or web page without OnlineLotto.co.za’s authorisation.
3. OnlineLotto.co.za may provide links to third party websites on OnlineLotto.co.za. These links are provided to the user for convenience purposes only and OnlineLotto.co.za does not endorse, nor does the inclusion of any link imply OnlineLotto.co.za’s endorsement of, such websites, their owners, licensees or administrators or such websites’ content or security practices and operations.

While OnlineLotto.co.za tries to provide links only to reputable websites or online partners, OnlineLotto.co.za cannot accept responsibility or liability for the information provided on other websites. Linked websites or pages are not under, nor subject to, the control of OnlineLotto.co.za. 5. You agree that OnlineLotto.co.za shall not be held liable, directly or indirectly, in any way for the content, the use or inability to use or access any linked website or any link(s) contained in a linked website, nor for any loss or damage of any sort incurred as a result of any dealings with, or as the result of the presence of such third party linked websites on OnlineLotto.co.za. Any dealings that you may have with any linked websites, including advertisers, found on OnlineLotto.co.za, are solely between you and the third-party website.

4. Usage restrictions

1. The user hereby agrees that it shall not itself, nor through a third party:

1. copy (other than for backup, archival or disaster recovery purposes), reproduce, translate, adapt, vary, modify, lease, licence, sub-licence, encumber or in any other way deal with any part of OnlineLotto.co.za for any reason and in any manner, unless it is consistent with the intent and purpose of these Terms and Conditions;

4. modify or enhance OnlineLotto.co.za. In the event of a user effecting any modifications or enhancements to OnlineLotto.co.za in breach of this clause, such modifications and enhancements shall be the property of OnlineLotto.co.za;
5. without Service Provider’s prior written consent, provide, disclose, divulge or make available to or permit the use of or give access to OnlineLotto.co.za by persons other than the user;
6. remove any identification, trademark, copyright or other notices from OnlineLotto.co.za;
7. post or transmit, by means of reviews, comments, suggestions, ideas, questions or other information through OnlineLotto.co.za, any content which is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually-explicit, profane or hateful, or racially, ethnically or otherwise objectionable content of any kind; and/or
8. notwithstanding anything contained to the contrary in these Terms and Conditions, use OnlineLotto.co.za for any purpose other than personal, non-commercial and information purposes.

5. Security

1. In order to ensure the security and reliable operation of the services to all OnlineLotto.co.za’s users, OnlineLotto.co.za hereby reserves the right to take whatever action it may deem necessary to preserve the security, integrity and reliability of its network and back-office applications.
2. You may not utilise OnlineLotto.co.za in any manner which may compromise the security OnlineLotto.co.za’s networks or tamper with the Website in any manner whatsoever, which shall include without limitation, gaining or attempting to gain unauthorised access to OnlineLotto.co.za, or delivering or attempting to deliver any unauthorised, damaging or malicious code to OnlineLotto.co.za, all of which is expressly prohibited. Any person or entity which does so, or attempts to do so, shall be held criminally liable. Further, should OnlineLotto.co.za suffer any damage or loss, civil damages shall be claimed by OnlineLotto.co.za against the user.
3. Any user who commits any of the offences detailed in Chapter 13 of the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) (specifically sections 85 to 88 (inclusive)) shall, notwithstanding criminal prosecution, be liable for all resulting liability, loss or damages suffered and/or incurred by Service Provider and its affiliates, agents and/or partners.

6. Intellectual property rights

1. For the purpose of this clause, “Intellectual property rights” means all and any of the rights in and to intellectual property of any nature whatsoever owned and/or controlled directly or under licence by OnlineLotto.co.za, now or in the future, including without limitation, OnlineLotto.co.za’a rights, title and interest in and to all technology, source code/s, trade secrets, logos, systems, methods, trademarks, trade names, styles, insignia, designs, patents and copyright, and all similar proprietary rights which may subsist in any part of the world, whether registered or not.
2. All copyright and other intellectual property rights in all content, trademarks, software, data, material, including logos, databases, text, graphics, icons, hyperlinks, confidential information, designs, agreements, and multimedia works, published on or via the Website (“proprietary material”), are the property of, or are licensed to, OnlineLotto.co.za and as such are protected from infringement by local and international legislation and treaties.
3. By submitting reviews, comments and/or any other content (other than your personal information) to OnlineLotto.co.za for posting on OnlineLotto.co.za, you automatically grant OnlineLotto.co.za and its affiliates a non-exclusive, royalty-free, perpetual, irrevocable right and licence to use, reproduce, publish, translate, sub-license, copy and distribute such content in whole or in part worldwide, and to incorporate it in other works in any form, media, or technology now known or hereinafter developed, for the full term of any copyright that may exist in such content. Subject to this licence, you retain any and all rights that may exist in such content.

5. Except with OnlineLotto.co.za’s express written permission, no proprietary material from OnlineLotto.co.za may be copied or retransmitted.
6. Irrespective of the existence of copyright, the user acknowledges that OnlineLotto.co.za is the proprietor of all material on OnlineLotto.co.za (except where a third party is indicated as the proprietor), whether it constitutes confidential information or not, and that the user has no right, title or interest in any such material.
7. 7. Risk, limitation of liability and indemnity

1. The user’s use of OnlineLotto.co.za and the information contained on OnlineLotto.co.za is entirely at the user’s own risk and the user assumes full responsibility and risk of loss resulting from the use thereof.
2. The transmission of information via the internet, including without limitation e-mail, is susceptible to monitoring and interception. The user bears all risk of transmitting information in this manner. Under no circumstances shall OnlineLotto.co.za be liable for any loss, harm, or damage suffered by the user as a result thereof. OnlineLotto.co.za reserves the right to request independent verification of any information transmitted via e-mail and the user consents to such verification should service provider deem it necessary.
3. To the extent permissible by law:

1. Neither OnlineLotto.co.za, its affiliates, shareholders, agents, consultants or employees shall be liable for any damages whatsoever, including without limitation any direct, indirect, special, incidental, consequential or punitive damages, howsoever arising (whether in an action arising out of contract, statute, delict or otherwise) related to the use of, or the inability to access or use the content of OnlineLotto.co.za or any functionality thereof, or the information contained on OnlineLotto.co.za, or of any linked website, even if OnlineLotto.co.za knows or should reasonably have known or is expressly advised thereof.
2. The liability of OnlineLotto.co.za for faulty execution of OnlineLotto.co.za as well as all damages suffered by the user, whether direct or indirect, as a result of the malfunctioning of OnlineLotto.co.za shall be limited to service provider rectifying the malfunction, within a reasonable time and free of charge, provided that OnlineLotto.co.za is notified immediately of the damage or faulty execution of OnlineLotto.co.za. This liability shall fall away OnlineLotto.co.za excluded if the user attempts to correct or allows third parties to correct or attempt to correct OnlineLotto.co.za without the prior written approval of OnlineLotto.co.za. However in no event shall OnlineLotto.co.za be liable to the user for loss of profits or for special, incidental, consequential or punitive losses or damages arising out of or in connection with OnlineLotto.co.za or its use.
3. You hereby unconditionally and irrevocably indemnify OnlineLotto.co.za and agree to hold OnlineLotto.co.za free from all loss, damages, claims and/or costs, of whatsoever nature suffered or incurred by OnlineLotto.co.za or instituted against OnlineLotto.co.za as a direct or indirect result of:

1. your participation in the Offering;
2. your failure to comply with any of the terms or any other requirements which OnlineLotto.co.za may impose from time to time;
3. any unavailability of, or interruption in, the Offering which is beyond the control of OnlineLotto.co.za.

4. OnlineLotto.co.za makes no warranty or representation as to the availability, accuracy or completeness of the content of Offering. You expressly waive and renounce all your rights of whatever nature that you may have against OnlineLotto.co.za any LOSS suffered by you, as a result of information supplied by service provider being incorrect, incomplete or inaccurate.

8. Service provider privacy and cookie policy

1. This clause provides details about our Privacy and Cookie Policy, which Policy forms part of these Terms and Conditions. OnlineLotto.co.za takes your privacy seriously and is committed to protecting your personal information. We use the personal information that we collect from you in accordance with this Privacy and Cookie Policy.
2. Personal information when used in this Policy means information that can identify you as an individual or is capable of identifying you. By personal information we don’t mean general, statistical, aggregated or anonymised information.
3. Your use of the Offering signifies your consent to us collecting and using your personal information as specified below.
4. How we collect information about you

1. For the purposes of managing your OnlineLotto.co.za account we capture and store your email address and encrypted password. Your Name, Surname, Email Address and Phone number are required to use your OnlineLotto.co.za account. Further information may be requested in order to verify your identity, your age and or eligibility to claim prizes or participate on OnlineLotto.co.za. Cookies are automatically served to your browser to enable you to manage your logged in and logged out states.

5. How we use your information

1. 3rd party web cookies further track an aggregate of OnlineLotto.co.za user journeys and interactions with the OnlineLotto.co.za website where data is stored on 3rd party platforms such as Google and Facebook and for marketing and advertising purposes. This aggregated information may be shared with 3rd party advertisers however will not contain your personally identifiable information. By accepting these terms we may further use your Email Address, Phone Number to contact you about services offered on OnlineLotto.co.za. This includes but is not limited to daily reminder emails or sms text to enter the next free draw or to conduct payouts. These emails / sms text messages may contain information and/oor offers from 3rd party advertisers on OnlineLotto.co.za.

6. How long do we keep your information for?

1. The time periods for which we keep your information may vary according to the use or purpose attached to the information. Unless there is a specific legal requirement requiring us to keep your information, however, we will not keep it for longer than necessary for the purpose for which the information was collected or for which it is to be processed.

7. Disclosing your information to third parties

10. Fraud

12. Compliance with laws

13. Notices
